Control of right of use & land lease agreements in electricity and fiber networks

Many network owners do not have control over whether they have right of use and land lease agreements for their lines. The fact that the lines run through many properties that have also changed owners several times since they were laid makes it virtually impossible to have full control.

Are the agreements recorded in the land register?

Agreements are often not recorded in the land register. The reasons can be several, for example

  • easements were allowed to be oral as late as 1972
  • previous pipeline owners have not drawn up land lease agreements
  • property boundaries are unclear.

In addition, properties may have changed ownership, been divided or merged with another property after they signed the land lease agreements but before they were entered in the land register. Or the pipeline crosses an undetermined property or community where it was unclear who should sign the agreements.

Often, the information is handled in large Excel files that have to be copied and pasted into the manually created agreements. This is where the human factor can be a source of error.

Current practice - manual checks

To check whether valid contracts exist, a lot of effort is required today, often in the form of deep dives into physical paper archives where the hours quickly tick away. Perhaps consultants are hired to check against official records and authorities.

A new way - matching wiring and property records

A new way to check if there are agreements is to use the known geographical routing and automatically match against the updated property register to find the properties and property owners where there should be a registered agreement or right of use at Lantmäteriet.

Find out what agreements are in the land register

Properties that have entries in the land register will be "green" while those without entries will be marked in red. For the green-marked properties, you can then request the registration acts from official registers and authorities for more detailed information.

Check against your own lists

If you have a list of properties for which you have contracts, you can check that it is correct. You import the list and match it with the properties that the pipeline route crosses and the relevant property owners. This way you can check that you have agreements with all properties.
